O presidente Luiz Inácio Lula da Silva (PT) sancionou nesta terça-feira (4) decreto que prevê o funcionamento ininterrupto das delegacias da mulher em todo o país. O texto foi publicado no Diário Oficial da União (DOU) e é assinado também pelos ministros Flávio Dino (Justiça) e Aparecida Gonçalves (Mulher). O decreto já começa a valer na data de publicação, nesta terça-feira.
Pelo decreto, as delegacias especializadas em atendimento à mulher vão funcionar todos os dias, 24 horas, inclusive em feriados e fins de semana. As unidades devem prestar ainda assistência psicológica e jurídica para as vítimas de violência.
O atendimento às mulheres nas delegacias deverá ser realizado em sala reservada e, preferencialmente, por policiais do sexo feminino. Os agentes, por sua vez, deverão receber treinamento adequado para permitir o acolhimento das vítimas de maneira eficaz e humanitária.
Nos municípios onde não houver delegacia especializada de atendimento à mulher, a delegacia existente deverá priorizar o atendimento, por agente feminina especializada, das mulheres vítimas de violência.
Lula instituiu, também, o Programa de Prevenção e Enfrentamento ao Assédio Sexual na administração pública, direta e indireta, em todos os níveis federativos. São objetivos prevenir e enfrentar a prática do assédio sexual; capacitar os agentes públicos para o desenvolvimento e a implementação de ações destinadas à discussão, à prevenção, à orientação e à solução do problema; implementar e disseminar campanhas educativas para esclarecer o que são as condutas e os comportamentos que caracterizam o crime.
Os órgãos e as entidades, por sua vez, deverão elaborar ações e estratégias destinadas à prevenção e ao enfrentamento do assédio sexual a partir das diretrizes: esclarecimento sobre os elementos que caracterizam o crime; fornecimento de materiais educativos; implementação de boas práticas para a prevenção do assédio; e divulgação da legislação e de canais acessíveis para denúncias.
Além disso, os órgãos devem criar programas de capacitação, com os seguintes conteúdos: causas estruturantes do assédio sexual; consequências na saúde das vítimas; meios de identificação, modalidades e desdobramentos jurídicos; direitos das vítimas, incluindo o acesso à Justiça e à reparação; mecanismos e canais de denúncia e instrumentos jurídicos de prevenção e de enfrentamento.
